The services covered by this regulation are offered for sale by Parcheggio Malpensa Airport srl, via Giuseppe Giusti 101 21019 Somma Lombardo VA, tax code and VAT number 02639730122 hereinafter referred to as “Low Cost Parking”

The following instructions regulate the relationships between Parcheggio Malpensa Airport srl, provider of the service and the users of this service (hereinafter referred to as USERS). The USER who uses the service, appoints on his behalf and on behalf of Parcheggio Malpensa Airport srl, to reserve the selected parking services; expresses his consent to the processing of his data according to L. 675/96 by entering the requested data on the web page and pays the price of the service as an advance payment, i.e. as “means necessary for the execution of the mandate” ( article 1719 of the Civil Code), is required to respect all the general conditions contained in this regulation. This regulation must therefore be read and approved in all its parts before completing the booking

Art. 1 – Object of the service

The object of the service is the intermediation for the online purchase of services relating to parking areas as indicated and offered for sale on the site www.parcheggilowcost.it

Art. 2 – Fee for services

Payment for the service is permitted by credit card belonging to the main circuits, in a secure manner. The transaction takes place exclusively in the banking context and Parcheggi Low Cost does not have in any way access to the buyer’s credit card data.

Any refunds due to the User will be credited through cancellation, even partial, of the operation and in case of exercise of the right of withdrawal, at the latest within 30 days from the date on which Parcheggi Low Cost became aware of the withdrawal same.

Art. 3 – Obligations of the buyer and the credit card holder

The buyer undertakes to read, carefully read and accept the contractual clauses referred to in this regulation, as a necessary condition for the purchase, as these are clauses drawn up in compliance with the articles. 3 and 4 of Legislative Decree 185/1999 (distance contract) and art. 12 of Legislative Decree 70/03 (electronic commerce).

The Buyer undertakes to pay the price of the purchased good in the times and ways indicated in the contract. The Buyer undertakes, once the online purchase procedure has been completed, to print and keep this contract.

The information contained in this contract has, moreover, already been viewed and accepted by the Buyer, who acknowledges it, as this step is made mandatory before the purchase confirmation.

Art. 4 – Method of stipulating the contract

The contract between Parcheggi Low Cost and the User is concluded via the Internet by accessing the User at the address www.parcheggilowcost.it  where, by following the procedures indicated, the user will formalize the proposal for the purchase of the services referred to in the art. 2 above.

Art. 5 – Rights and obligations of Parcheggio Malpensa Airport srl

The purchase contract is concluded through the exact completion of the request form and the consent to the purchase expressed through the subscription sent online, after viewing a printable order summary web page, in which the reported the details of the user and the service purchased, the price of the service purchased, any additional additional charges, the methods and terms of payment and the existence of the right of withdrawal.

Parcheggio Malpensa Airport srl undertakes to send by e-mail the receipt of the User’s order, with a summary of the essential information relating to the service, a detailed indication of the price, means of payment and additional costs. The order and the order confirmation receipt are considered to have been received when the parties to whom they are addressed have the possibility of accessing them. Therefore, the buyer must diligently keep: the order confirmation sent via email from Parcheggi Low Cost with the summary of the purchase.

Art. 6 – Rates

The sales rates of the services offered are expressed in euros and constitute an offer to the public pursuant to art. 1336 c.c.

The sales rates, referred to in the previous point, include VAT.

The rates indicated for each of the services offered are valid until the date of use of the service

Art. 7 – Waiver

A full refund of the price of the service is always expected in the event of cancellation by the User, if the insurance option has been selected and confirmed during the online purchase.

In the event that the insurance option has not been selected and confirmed, the price of the service will be refunded in the event of cancellation by the User with the application of the following penalties:
penalty of 10 % from the online transaction to 8 days before the acceptance/check-in date;

50% penalty from 7 days up to 2 days before the acceptance/check-in date;

100% penalty from 1 day up to the same day from the acceptance/check-in date;

If the User decides to request a refund, he must communicate this to Parcheggio Malpensa Airport srl, by email by writing to the e-mail AMMINISTRAZIONE@PARCHEGGILOWCOST .IT

The date indicated on the email will prevail between the Parties, taking into account the Italian time zone.

Upon receipt of the communication with which the User communicates the exercise of the right of withdrawal, the Parties to this contract are released from their mutual obligations, without prejudice to the provisions of the previous points of this article.

Art. 8 – Causes for termination

The obligations assumed by the User, as well as the guarantee of the successful completion of the payment that the User makes with the means referred to in point 3, and also the exact fulfillment of the obligations assumed by Parcheggio Malpensa Airport srl in point 5, have an essential character, so that, by express agreement, the failure to fulfill just one of these obligations, unless determined by fortuitous circumstances or force majeure, will result in the legal termination of the contract pursuant to art. 1456 of the Civil Code, without the need for a judicial ruling.

Art. 10 – Method of archiving the contract

Pursuant to art. 12 of Legislative Decree 70/2003, Parcheggio Malpensa Airport srl informs the Buyer that each order sent is stored in digital form on the Supplier’s server according to confidentiality and security criteria.

Art. 11 – General

If services are purchased on behalf of a third party, consent to these terms and conditions is deemed to be given on behalf of oneself and as a representative of the third party.
